The CEO of the industrial enterprise repeatedly appealed to the local administration with the issue of bringing the municipal road running between the production site and the city recreation park into a standard condition, but received refusals and unsubscriptions.
Then, to protect his rights and legitimate interests, the entrepreneur turned to the Moscow Business Ombudsman Vladimir Golovnev.
Having studied the applicant's arguments, the Commissioner instructed Anatoly Shestakov, the head of the public reception in the Balashikha city district, to investigate the circumstances of the case. The reception initiated a meeting between the entrepreneur and the city prosecutor.
On the basis of the entrepreneur's appeal, a prosecutor's check was carried out, during which it was established that the administration allowed violations of legislation in the field of road safety. The city prosecutor appealed to the court with an administrative claim.
The prosecutor's claim for recognition of the administration's inaction as illegal has been satisfied. The municipality is responsible for bringing the road into a standard condition.
