The Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow    region Vladimir Golovnev was approached by a businessman from Vidnoye city district, engaged in the wholesale trade of fish and seafood, with a complaint about the actions of law enforcement agencies during the investigation of a criminal case.

A criminal case was initiated against the director and an employee of the company under the article for the illegal acquisition and storage of sturgeon, which belong to especially valuable aquatic biological resources.

During the personal reception, the applicant claimed that law enforcement officers were putting pressure on him to give evidence confirming the validity of the initiation of a criminal case. In addition, the investigator sent a letter to the contractors demanding that all fish products purchased from the company be excluded from sale.

Having studied the materials, the Business Ombudsman sent a letter to the Prosecutor's office of the Moscow Region with a request to verify the circumstances that gave rise to the appeal of the CEO of the company and take measures of prosecutorial response if there are grounds.

In connection with the revealed violations of criminal procedure legislation by the Prosecutor's Office of the Moscow Region, the head of the Main Investigative Department of the Investigative Committee of the Russian Federation for the Moscow Region submitted a request in accordance with paragraph 3. part 2. of Article 37 of the Code of Criminal Procedure of the Russian Federation, which was satisfied, and information was sent to the company's counterparties-a rebuttal to the investigator's letter. It was explained to the entrepreneur that he has the right to apply to the court for compensation for losses caused to him and compensation for moral damage.

Currently, the investigation of the case has not yet been completed, investigative and procedural actions aimed at establishing all the circumstances to be proved under Article 73 of the Code of Criminal Procedure of the Russian Federation continue to be carried out.

The supervision of the progress and results of the investigation of a criminal case is ensured by the Prosecutor's office.
