Thanks to the interaction of the Moscow Region and the Commissioner for the Protection of the Rights of Entrepreneurs in Tver city, the ban on registration actions was lifted from the entrepreneur.
The Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev received an appeal from his colleague of the Tver region Anton Stamplevsky.
A local car dealership purchased a car for the purpose of further sale, but faced a problem: the imposition of a ban on registration actions due to the tax debt of the previous owner. Despite the fact that the decisions of the Moscow District Court of Tver assigned the Shchelkovsky district bailiff department the duty to lift the ban, the car dealership independently failed to enforce these decisions.
Since the complaint was filed against the inaction of employees of the territorial division of the Main Directorate of the Federal Bailiff Service for the Moscow Region, the Commissioner in the Tver Region turned to the Moscow Region Commissioner for assistance.
Having studied the materials of the appeal, Vladimir Golovnev appealed to the prosecutor's office of the Moscow Region with a request to verify the circumstances that gave rise to such an appeal by an entrepreneur from a neighboring region.
The regional Prosecutor's Office conducted a comprehensive audit, according to the results of which the head of the Main Department of the Federal Bailiff Service of Russia in the Moscow Region was presented with an idea on eliminating violations of the norms of the current legislation on enforcement proceedings.
As a result of the measures taken, the ban on registration actions in relation to the applicant's car was lifted.
- "The Constitution of Russia guarantees domestic entrepreneurs the unity of the economic space, support for competition, and freedom of economic activity. The Commissioner's competence includes not only the protection of the Moscow Region business community, but also those business entities whose rights and legitimate interests have been violated by public authorities operating in the Moscow Region. I receive similar requests from time to time. It's not just Moscow and the border regions. This year, entrepreneurs from the Voronezh, Penza, Sverdlovsk regions and other subjects of Russia applied for protection of their rights. I take the consideration of such complaints under my personal control, since it is not only about restoring the violated rights of the applicant, but also about the business reputation of our region.”
